1. Accepting These Terms

By accessing or using Shimmerscape ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. You must be at least 13 years old to use Shimmerscape.

2. Your Account

You are responsible for maintaining the security of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately if you believe your account has been compromised.

3. Your Content

You retain ownership of all content you upload to Shimmerscape (photos, videos, text, etc.). By uploading content, you grant Shimmerscape a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content as part of the Service — for example, showing your tank page to visitors, displaying thumbnails in search results, or featuring your tank on the explore page.

You agree not to upload content that:

• You do not have the right to share
• Is illegal, harmful, or promotes violence
• Infringes on others' intellectual property rights
• Contains malware or destructive code
• Is spam, misleading, or deceptive
• Violates another person's privacy

4. Service Limits

Free accounts include 2 GB of media storage. Storage limits are enforced per account. We reserve the right to modify storage limits with reasonable notice. If your usage exceeds your limit, you will need to delete content before uploading new media.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to other users' accounts or data
• Interfere with or disrupt the Service or its infrastructure
• Scrape or harvest data from the Service without permission
• Use automated tools to create accounts or upload content
• Impersonate another person or entity

6. Intellectual Property

Shimmerscape's name, logo, design, and code are the property of Shimmerscape. You may not copy, modify, or distribute our branding or proprietary materials without written permission.

7. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time from the Account settings page. Upon deletion, all your data will be permanently removed per our Privacy Policy.

8. Disclaimers

Shimmerscape is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free. We are not responsible for any loss of data, though we take reasonable precautions to prevent it.

9. Limitation of Liability

To the maximum extent permitted by law, Shimmerscape shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data or content.

10. Changes to These Terms

We may update these terms from time to time. We will notify you of significant changes by posting a notice on the Service. Your continued use after changes are posted constitutes acceptance.
